USER AGREEMENT
1. Account Usage Terms
1.1 Under the California Consumer Privacy Act (CCPA) and the Health Insurance Portability and Accountability Act (HIPAA), you must maintain the confidentiality of your account credentials. All account activity will be deemed authorized by you.
1.2 If a security breach is detected, you are obligated to report it within a reasonable timeframe via accurateinc@accuratedenver.com
1.3 User conduct must comply with the Computer Fraud and Abuse Act (CFAA) and the Communications Decency Act (CDA) Section 230 regarding online behavior standards.
2. Prohibited Activities
2.1 The following are strictly prohibited:
· Spam messages violating the Controlling the Assault of Non-Solicited Pornography and Marketing (CAN-SPAM) Act
· Unauthorized data collection (under CCPA and state privacy laws)
· System attacks violating the CFAA
· False identity activities (under state fraud laws and the Identity Theft Penalty Enhancement Act)
3. Payment Terms
3.1 Under the Electronic Fund Transfer Act (EFTA) and the Uniform Commercial Code (UCC):
· Fraudulent transactions will be immediately reversed
· No contractual relationship is established until payment is completed
4. Breach & Termination
4.1 Under the Terms of Service:
· Material breaches will result in service termination
· The company reserves the right to pursue legal action under the CFAA and applicable state laws
5. Intellectual Property
5.1 Compliance with:
· The Digital Millennium Copyright Act (DMCA)
· U.S. Copyright Law (17 U.S.C. § 101 et seq.)
6. System Security
6.1 Prohibited actions include:
· Violations of CFAA Section 1030
· Breaches of state data security laws
7. Transaction Terms
7.1 Under the UCC and the Magnuson-Moss Warranty Act:
· Digital goods may be subject to state cooling-off periods
· Resale risks are solely borne by the buyer
8. General Provisions
8.1 You acknowledge and agree to:
· Compliance with the Stored Communications Act (SCA) and the Electronic Communications Privacy Act (ECPA)
· Jurisdiction under [Company’s State of Incorporation] law (e.g., Delaware)
· Dispute resolution via [Arbitration Body, e.g., AAA]
